You are a highly valued Customer, and we look forward to hosting you as our guest. This document is designed to make you fully aware of the terms, conditions, and policies governing your participation on our tours, so that you may enjoy a safe and fulfilling journey. It is also a legal document that requires your careful attention. Agreeing to these policies when booking one of our tours or services creates a contractual relationship between you and Moody Journeys by Flytrail.
After reading this entire Customer Agreement (the “Agreement”), you must indicate your acceptance of the terms & conditions found herein. The terms described herein, in combination with your online reservation forms along with your invoice and other applicable documents mentioned below, constitute the entire mutual Agreement between us.
This is the Customer Agreement between Customer (You) & Moody Journeys by Flytrail. Please read the Agreement carefully.
INTRODUCTION TO OUR SERVICES:
Moody Journeys by Flytrail offers carefully curated non-self-drive coach tours across the world. Each journey is designed to let you experience the essence of a destination in comfort, with all logistics managed by our team and our professional drivers.
We do expect the following qualities from customers on our expeditions:
Respect for local cultures, communities, and fellow travelers.
Cooperation with tour guides, drivers, and staff to ensure smooth operations.
Adherence to safety guidelines and schedules.
Unlike our sister brand Flytrail, which conducts self-drive tours, Moody Journeys tours are fully guided and chauffeur-driven, so you can relax and enjoy the experience without having to drive.
PAYMENT INFORMATION:
A deposit is required to confirm a reservation, which shall be determined at the time of booking. For confirmed reservations, final payment in the form of a bank transfer (RTGS, NEFT), cheque, digital transfer or all major credit cards must be received by the date determined at the time of booking. Failure to comply with the deposit and final payment schedules will result in automatic cancellation of pending reservations.
PUBLISHED RATES, DATES & ITINERARIES:
Moody Journeys by Flytrail reserves the right to change itineraries without prior notice for various factors including, but not limited to – safety, weather, unforeseen emergencies, or minimum group size requirements.
All rates for transportation, accommodations, and other services are based on tariffs and exchange rates in effect at the time of printing and are subject to change.
YOUR TRAVEL DOCUMENTS:
It is the responsibility of the Customer to be in possession of all valid travel documents (passport, visa, etc.) prior to and during the entire journey with Moody Journeys by Flytrail.
FLIGHT TICKETS & VISA:
You are required to make the necessary arrangements for flight tickets and visa applications and share the same with Moody Journeys by Flytrail prior to the start of the expedition.
INSURANCE:
Moody Journeys by Flytrail strongly recommends that you purchase comprehensive travel insurance that includes:
Emergency medical evacuation
Trip cancellation/interruption coverage
Baggage loss protection
MEDICAL & HEALTH ISSUES:
You agree that you are in good health and physically fit to participate in a group coach tour. Customers with pre-existing medical conditions must consult their physician and inform Moody Journeys by Flytrail at the time of booking.
If a participant requires medical assistance during the trip, our accompanying team will arrange transportation to the nearest medical facility. Extra costs for medical treatment, transfer, or repatriation will be the participant’s responsibility.
PHOTOGRAPHY:
Moody Journeys by Flytrail reserves the right to take photographs or videos during the tour for promotional purposes. By booking, you grant us permission to use your image unless you explicitly request otherwise in writing prior to departure.
SPECIAL DIETS:
Customers with special dietary needs must inform Moody Journeys by Flytrail in advance. Every effort will be made to cater to such requests within reason and subject to availability.
CANCELLATION OF A TOUR BY MOODY JOURNEYS BY FLYTRAIL:
On the rare occasion a tour must be canceled, the following options will be offered (provided full payment was made):
A replacement tour at a later date of equal value.
A refund of the full net amount paid for the tour.
Refund responsibility is limited strictly to the payments received for the original booking.
INABILITY TO PERFORM:
Moody Journeys by Flytrail shall not be held liable for cancellations, delays, or changes caused by force majeure events including strikes, industrial action, war, riots, acts of terrorism, natural disasters, weather conditions, government regulations, or other circumstances beyond our control.
CUSTOMER OBLIGATIONS:
Customers are expected to:
Follow safety instructions provided by guides and staff.
Maintain respectful behavior toward fellow travelers, staff, and local communities.
Abide by all laws and regulations of the country visited.
Moody Journeys by Flytrail reserves the right to disembark any customer displaying disruptive, unsafe, or unlawful behavior without refund.
FORBIDDEN ITEMS & ILLEGAL SUBSTANCES:
Carrying dangerous items (weapons, explosives, inflammables) is strictly prohibited.
Possession or use of illegal substances will result in immediate removal from the tour without refund and may be reported to local authorities.
LIABILITY & ASSUMPTION OF RISK:
Participation in a Moody Journeys by Flytrail tour involves inherent risks such as unpredictable weather, terrain, and other factors beyond our control. By booking, you acknowledge these risks and agree to release Moody Journeys by Flytrail, its owners, partners, and employees from liability to the fullest extent permitted by law.
In the event of disputes, they will be settled under Indian law, with Siliguri, India, as the venue for arbitration.
LAND SERVICES:
Moody Journeys by Flytrail works with independent suppliers for hotels, transport, and other services. While we carefully select partners, we are not responsible for any delays, mishaps, or irregularities caused by these third parties.
